Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, customers, and others who access or use the Service or engage Lowery for plumbing, heating, or air conditioning work.

By accessing or using the Service, or by requesting or accepting services from Lowery, you agree to be bound by these Terms. If you disagree with any part of these Terms, please do not use the Service.

1. Services

Lowery provides licensed plumbing, heating, and air conditioning services to residential and commercial customers in Lubbock, TX and surrounding areas. All services are subject to availability, scheduling, and the discretion of Lowery and its technicians. Estimates provided over the phone, online, or in person are non-binding until confirmed in writing or by signed work order.

Lowery operates a 24-hour dispatch line and may engage authorized third-party vendors, to operate after-hours and overflow call center functions on its behalf.

2. Estimates, Pricing, and Payment

  • Free estimates are provided as described on our website and are valid for the period stated on the estimate.
  • Final pricing is determined by the actual scope of work performed and is presented to the customer prior to the start of work whenever practical.
  • Payment is due upon completion of services unless other terms have been agreed to in writing.
  • Lowery accepts payment by approved methods as posted at the time of service. Customers are responsible for any returned-check, chargeback, or collection fees associated with non-payment.

3. Warranties and Guarantees

Lowery stands behind its workmanship as described in the Lowery Guarantee posted on our website. Manufacturer warranties on parts and equipment are passed through to the customer and are governed by the manufacturer’s terms. Except as expressly set forth in writing, Lowery makes no other warranties, express or implied, regarding services performed.

4. SMS / Text Messaging Terms

Lowery operates an SMS program for transactional and operational communications with customers and on-call technicians. This program is operated on Lowery’s behalf by its authorized vendor, GriffinWink Advertising.

Program Description

  • Customer-facing messages: appointment confirmations, reminders, technician dispatch and arrival notifications, rescheduling notices, and service follow-up.
  • Internal technician messages: customer dispatch details (name, address, phone, service issue), schedule changes, and on-call rotation confirmations.

Messages are operational and transactional only. No marketing or promotional content is sent through this program.

Opt-In

By providing your mobile phone number to Lowery through a service request, contact form, phone conversation, or signed acknowledgment, and by affirmatively consenting to receive text messages, you agree to receive SMS messages from Lowery and its authorized vendor. Technicians opt in by signing a written SMS Dispatch Consent Acknowledgment as a condition of participating in the on-call rotation.

Message Frequency

Message frequency varies based on your service activity and, for technicians, your position in the on-call rotation. You may receive multiple messages per day during active service or on-call periods.

Message and Data Rates

Standard message and data rates from your wireless carrier may apply. Lowery and GriffinWink are not responsible for any charges imposed by your carrier.

Opt-Out

You may opt out of receiving SMS messages at any time by replying STOP to any message. You will receive a one-time confirmation, and no further messages will be sent. You may opt back in by replying START.

Supported Carriers

Compatible with major U.S. wireless carriers including AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, Boost Mobile, MetroPCS, Cricket Wireless, and Virgin Mobile. T-Mobile is not liable for delayed or undelivered messages. Carriers are not liable for delayed or undelivered messages.

Privacy

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Lowery and its licensors. The Lowery name, logo, and related marks are trademarks of Lowery and may not be used without prior written permission.

6. Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by Lowery. Lowery has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Lowery shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services.

7. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Services performed by Lowery technicians are subject to the warranties described in Section 3.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Lowery, its officers, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Service, or any conduct or content of any third party on the Service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or the Service shall be brought in the state or federal courts located in Lubbock County, Texas.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements regarding the Service.

11. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised Terms.
